Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ServBuilder platform and website operated by ServBuilder, LLC ("ServBuilder," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our platform, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using ServBuilder on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not access or use our services.

2. Description of Service

ServBuilder is a software-as-a-service (SaaS) field service management platform designed for small and mid-sized home service businesses. Our platform provides tools for scheduling, dispatching, quoting, invoicing, customer management, and mobile workforce coordination.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to active subscribers.

3. Account Registration and Security

To use ServBuilder, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Subscription and Billing

ServBuilder offers monthly subscription plans. No annual contract is required. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.

  • All fees are billed monthly in advance
  • Prices are listed in US dollars and are subject to change with 30 days' notice
  • Payments are processed securely through Stripe
  • Refunds are not provided for partial billing periods after cancellation

If payment fails, we will attempt to notify you and may suspend access until the outstanding balance is resolved.

5. Free Trial Terms

ServBuilder offers a 14-day free trial with no credit card required. During the trial period, you have access to the full platform features.

  • The trial begins on the date of account creation
  • At the end of the trial, you must subscribe to a paid plan to continue using the platform
  • If you do not subscribe, your account will be downgraded and data may be deleted after 30 days
  • We reserve the right to modify or discontinue the free trial at any time

6. Acceptable Use

You agree not to use ServBuilder to:

  • Violate any applicable local, state, national, or international law
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of the platform
  • Use the platform for any purpose other than legitimate business operations
  • Scrape, crawl, or harvest data from the platform without authorization
  • Resell or redistribute access to the platform without written consent

7. Intellectual Property

All content, features, and functionality of the ServBuilder platform, including but not limited to the software, design, text, graphics, logos, and trademarks, are owned by ServBuilder, LLC and are protected by US and international intellectual property laws.

You retain ownership of any data you input into the platform. By using our services, you grant us a limited license to process and store your data solely for the purpose of providing the service.

8. Limitation of Liability

To the maximum extent permitted by law, ServBuilder, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the platform.

Our total liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid to ServBuilder in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

ServBuilder is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

You may terminate your account at any time by contacting us or using the account settings in the platform. We may terminate or suspend your account at any time for violation of these Terms, with or without notice.

Upon termination, your right to use the platform ceases immediately. We will make your data available for export for 30 days following termination, after which it may be permanently deleted.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify active subscribers by email and update the "Last updated" date at the top of this page.

Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the platform and close your account.
